Hanko: Coffee Passport Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "User") and:

Jericho Francis A. Carlos, a Philippine sole proprietor trading as Hanko Coffee

(the "Operator," "we," "our," or "us")

with principal place of business in the Republic of the Philippines and contact address hello@hankocoffee.app.

These Terms govern your access to and use of the Hanko: Coffee Passport mobile applications for iOS and Android, the website at hankocoffee.app, the API at api.hankocoffee.app, and any related features, content, and services (together, the "Service").

By creating an account, installing the App, or otherwise using the Service, you agree to these Terms and to the Privacy Policy available at hankocoffee.app/privacy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least eighteen (18) years old to use the Service. At registration you are required to truthfully declare your age. Accounts for users declared to be under 18 are automatically denied. You represent and warrant that you have the legal capacity to enter into these Terms under the laws of your jurisdiction and that your use of the Service does not violate any law applicable to you.

If we discover that you misrepresented your age or eligibility, we may suspend or terminate your account immediately. Any refund rights remain subject to mandatory law and the applicable app-store policy.

3. The Service

Hanko: Coffee Passport is a coffee-logging and discovery application. It lets you:

  • find, view, and contribute cafes on a map;
  • create a personal "journey" of cafes you have visited;
  • log drinks, write reviews, upload photos, and collect passport-style achievements;
  • follow other users (where enabled) and view public content they post.

The Service is provided for personal, non-commercial use only, except as expressly permitted by these Terms or by a separate written agreement with us.

We may add, modify, or remove features at any time. Some features may require a paid subscription (see Section 6).

4. Your Account

To use most features you must create an account. You may sign up using your email address or through a supported identity provider (currently Google or Apple). You agree to:

  1. provide accurate, current, and complete information during registration and keep it up to date;
  2. keep your credentials confidential and not share them;
  3. be responsible for all activity under your account;
  4. promptly notify us at hello@hankocoffee.app of any suspected unauthorized use or security incident.

You may delete your account at any time through in-App settings or by submitting a request at https://hankocoffee.app/request. Deletion is processed as described in the Privacy Policy.

5. User Content

5.1 What counts as User Content

"User Content" means anything you submit to the Service, including cafe contributions, log entries, reviews, photos, ratings, comments, profile information, and messages sent through our support channels.

5.2 You keep ownership; you grant us a license

You retain all rights you have in your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting, resizing, moderation, and similar technical purposes), distribute, publicly display, and publicly perform your User Content solely to operate, promote, and improve the Service. This license continues for as long as the User Content exists on the Service and for a reasonable archival period afterward. The license ends when you or we delete the User Content, except to the extent necessary for us to comply with law, retain backup copies in the ordinary course, or defend a legal claim.

You represent and warrant that you own or have the necessary rights and permissions to your User Content and that it does not infringe the rights of any third party or violate any law. If your User Content includes identifiable images or data of another person, you represent that you have that person's permission.

5.3 What you may not post

You agree not to submit User Content that:

  • is unlawful, defamatory, obscene, harassing, hateful, threatening, or invasive of privacy;
  • contains sexually explicit material, content that sexualizes minors, or content that depicts real-world violence for its own sake;
  • promotes illegal drugs, firearms, gambling, or other activities prohibited in your jurisdiction;
  • infringes any copyright, trademark, trade secret, right of publicity, or other proprietary right;
  • is false or misleading in a way that could deceive other users (for example, fake cafe listings, paid-for reviews presented as organic);
  • contains malware, exploits, or links intended to harm others;
  • reveals another person's personal data without their consent;
  • violates the Apple Media Services Terms, the Google Play Developer Policies, or any other applicable platform policy.

5.4 Moderation

We may, but are not obligated to, review, screen, or remove any User Content at our discretion, with or without notice. Removal does not create an obligation to review or remove other content.

6. Subscriptions, Purchases, and Refunds

6.1 Paid features

Certain features may be offered as a paid subscription or one-time purchase ("Paid Features"). Prices, billing cycles, and features are disclosed at the point of purchase.

6.2 Who you buy from

All purchases are made through the Apple App Store or Google Play Store and are subject to the applicable platform's terms. Subscription entitlements are verified on our behalf by RevenueCat, Inc.

Your payment relationship for the transaction is with Apple or Google (and their designated payment processors), not with us. We do not receive your full payment-card number.

6.3 Auto-renewal

Subscriptions auto-renew at the price and cadence disclosed at purchase unless you cancel at least 24 hours before the end of the current period, in accordance with the applicable app store rules. You can manage or cancel subscriptions in your Apple ID or Google Play account settings. Cancelling a subscription stops future renewals but does not refund the current period, except as required by law.

6.4 Refunds

Because the payment is between you and the app store, refunds are handled by the app store in accordance with its policies. For Apple, see https://reportaproblem.apple.com. For Google, see the Google Play Help Center.

If mandatory Philippine consumer-protection law or EU consumer-rights law gives you a stronger refund right than the app-store policy, that stronger right applies. For EEA/UK users, the 14-day right of withdrawal under the Consumer Rights Directive may apply; where permitted by law, by beginning to use digital content immediately upon purchase, you acknowledge and agree that the right of withdrawal ends once the content is first delivered.

6.5 Taxes

Prices shown may or may not include value-added tax ("VAT"), goods-and-services tax ("GST"), or other sales taxes. Apple and Google collect applicable taxes on our behalf where required.

6.6 Price changes

We may change subscription prices. Where required by law or platform policy, we will give you advance notice (typically at least thirty (30) days) and the opportunity to cancel before the new price takes effect.

7. Acceptable Use

You agree not to, and not to attempt to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • reverse engineer, decompile, disassemble, or derive the source code of the App except to the extent this restriction is prohibited by applicable law;
  • use bots, scrapers, or other automated tools to access the Service or extract data, except as expressly permitted by us in writing or via a documented API;
  • probe, scan, or test the Service's vulnerability without our written authorization; submissions to a coordinated disclosure program, if one is published, are welcome;
  • interfere with the Service, servers, or networks, including by sending malware or launching denial-of-service attacks;
  • circumvent rate limits, access controls, or geographic restrictions;
  • use the Service to build a competing product or to benchmark it for competitive purposes;
  • impersonate another person or misrepresent your affiliation with any person or entity.

8. Intellectual Property

The Service, including the App, the Website, the API, our logos, trade names, source code, designs, and other content we provide (excluding User Content), is owned by or licensed to the Operator and is protected by Philippine and international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the App on devices you own or control, solely for your personal, non-commercial use of the Service.

No license is granted by implication, estoppel, or otherwise other than as expressly set out here.

If you believe content on the Service infringes your intellectual property rights, send a notice to hello@hankocoffee.app identifying the work, the allegedly infringing material, your contact information, a good-faith statement, and your signature (electronic is acceptable).

9. Third-Party Services

The Service integrates with third-party services, including Supabase, Railway, Vercel, Cloudflare, RevenueCat, Google, and Apple, as detailed in the Privacy Policy. Your use of those third-party services is governed by their own terms. For each third party's privacy practices, see the privacy notice links in Section 7 of our Privacy Policy. We are not responsible for the acts or omissions of any third party.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:

  • the Service will be uninterrupted, timely, secure, or error-free;
  • any User Content or cafe information is accurate, complete, or up to date (cafes open, close, change menus, and may be inaccurately reported; verify before travelling);
  • defects will be corrected; or
  • the Service is free of viruses or other harmful components.

You are responsible for your own safety when travelling to cafes identified through the Service, including local conditions, operating hours, and your interactions with other users.

Nothing in this Section limits any warranty or right that cannot be excluded or limited under applicable law (for example, mandatory statutory warranties under the Philippine Consumer Act, the EU Consumer Sales Directive, or comparable consumer-protection statutes in your jurisdiction).

11. Limitation of Liability

To the maximum extent permitted by law, the Operator's total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Service, in contract, tort, or otherwise, is limited to the greater of (a) the amount you paid us, or paid to Apple or Google for Paid Features on our behalf, in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars (USD 100.00).

We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or cost of substitute services, even if advised of the possibility.

These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Nothing in this Section limits liability that cannot be excluded or limited under applicable law, including liability for death, personal injury caused by our negligence, fraud, or gross negligence.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Operator from and against any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party right. We may, at our option, assume the exclusive defense and control of any matter otherwise subject to indemnification, and you will cooperate with our defense.

13. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, if we are required to do so by law, if operating the Service is no longer commercially viable, or if needed to prevent harm to users or third parties.

You may stop using the Service at any time by deleting your account. Sections 5.2 (license for residual User Content), 8 (IP), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 15 (Governing Law), 16 (Dispute Resolution), and 17 (General) survive termination.

14. Platform-Specific Terms

14.1 Apple (iOS users)

If you download the App from the Apple App Store, the following applies. You acknowledge that these Terms are between you and us, not with Apple, and that Apple has no obligation to furnish maintenance or support for the App. In the event of a failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or a third party relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14.2 Google (Android users)

If you download the App from Google Play, your use is also governed by the Google Play Terms of Service. We, not Google, are solely responsible for the App and for any claims related to it.

15. Governing Law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Mandatory consumer-protection laws of the jurisdiction in which you reside continue to apply to you where they cannot be excluded by contract.

16. Dispute Resolution

16.1 Informal resolution first

Before filing a formal claim, you agree to contact us at hello@hankocoffee.app and attempt to resolve the dispute informally. We will try to respond within thirty (30) days.

16.2 Venue

If informal resolution fails, and subject to mandatory consumer-protection law of your place of residence, any action at law or in equity must be brought exclusively in the competent courts of Quezon City, Metro Manila, Philippines, and you consent to the personal jurisdiction of those courts.

16.3 Data-privacy complaints

If your dispute involves the handling of your personal data, you may also file a complaint with the National Privacy Commission at privacy.gov.ph, or, for EEA/UK users, with your local supervisory authority.

17. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us concerning the Service and supersede any prior agreements.
  • Changes. We may update these Terms from time to time. Material changes will be announced by email or in-App notice at least fifteen (15) days before they take effect. Continued use after the effective date constitutes acceptance.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in effect.
  • No waiver. Our failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets, on notice to you.
  • No agency. These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship.
  • Electronic communications. You consent to receive notices electronically at the email address on file. Notices take effect when sent.
  • Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control, including acts of God, natural disaster, pandemic, war, civil disturbance, government action, strike, power failure, or internet outage.
  • Headings are for convenience only and do not affect interpretation.
